Terms of Service

1. The Service

LibStack provides cloud-based library management software including digital library cards, book cataloging, QR / barcode scanning, overdue notifications, analytics, and reporting tools, intended for use by schools, colleges, and universities.

2. Account Registration

• You must provide accurate information when creating an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your Institution's account, including activity by staff you grant access to.

3. Free Trial

• New Institutions are entitled to a 14-day free trial with full feature access, no credit card required.
• At the end of the trial, you must choose a paid plan to continue using the Service. No charges occur automatically without your action, unless otherwise stated at signup.

4. Fees & Payment

• Pricing for paid plans is available on our Pricing page or upon request.
• Fees are billed [monthly / annually] in advance.
• We reserve the right to change pricing with 30 days' notice to existing customers.
• Non-payment may result in suspension of access after a grace period of [X days].

5. Data Ownership

• All data you input into LibStack (book catalog, student records, transaction history) belongs to you (the Institution), not to LibStack.
• If you cancel your subscription, we will provide a full export of your data in CSV / Excel format upon request, within [X days].
• We do not claim ownership over your institutional data and will not use it for purposes outside operating the Service for you.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to access another Institution's data without authorization
• Reverse-engineer, scrape, or resell the Service without our written permission
• Upload malicious code or attempt to disrupt the Service

7. Institution Responsibilities

As the data controller for your students’ information, you agree to:

• Obtain any necessary consent from parents / guardians before adding student data, where required by law
• Ensure staff with access to LibStack handle student data responsibly
• Notify us promptly if you suspect unauthorized access to your account

8. Service Availability

• We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.
• We are not liable for downtime caused by third-party infrastructure providers (e.g., hosting, database providers) beyond our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by law, LibStack and its owner shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability for any claim shall not exceed the fees paid by you in the preceding [3 / 6 / 12] months.

10. Termination

• You may cancel your subscription at any time; access continues until the end of the current billing period.
• We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.

11. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in [your city, e.g., New Delhi].

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
